Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Vododex website at www.vododex.comand our mobile applications (together, the “Service”), operated by Vododex (“Vododex,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please also review our Privacy Policy, which explains how we handle your information and is incorporated into these Terms by reference.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you can form a binding contract with us.

2. Your Account

Some features require an account. You agree to provide accurate information, to keep your password confidential, and to be responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. The Service — Reference Information Only

Vododex is a free collection-tracking tool and price-guide reference. We are an information service and do not buy, sell, grade, appraise, or facilitate transactions in trading cards. Prices, valuations, market movements, and other data are estimates compiled from third-party sources, are provided “as is” for general informational purposes, and may be inaccurate, incomplete, or out of date. You are solely responsible for any decisions you make based on the Service, and nothing on the Service is financial, investment, or appraisal advice.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Scrape, harvest, or bulk-download data, or access the Service through automated means, except as expressly permitted by us.
• Interfere with or disrupt the Service, or attempt to gain unauthorized access to any systems or accounts.
• Upload or transmit malicious code, or content that is unlawful, infringing, or abusive.
• Misrepresent your identity or impersonate any person or entity.
• Resell, sublicense, or commercially exploit the Service without our permission.

5. User Content

The Service lets you record the cards and collections you own and, optionally, make a public profile. You retain ownership of the content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service (including displaying your public profile where you choose to make it public). You are responsible for your content and represent that you have the rights to submit it.

6. Intellectual Property

The Service, including its software, design, text, and graphics (excluding user content and third-party materials), is owned by Vododex and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

7. Third-Party Content, Trademarks, and Affiliations

Card names, images, set data, and related materials are the property of their respective owners. Vododex is an independent service and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Konami, Disney, Ravensburger, Bandai, or any other rights holder or trading-card publisher. Product and company names are used for identification purposes only.

8. Advertising and Affiliate Links

The Service is supported by advertising and may contain affiliate or partner links, including to marketplaces such as TCGPlayer and eBay. If you click these links and make a purchase, we may earn a commission at no additional cost to you. We are not responsible for third-party websites, products, or services, and your dealings with them are solely between you and the third party.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT DATA OR PRICING IS ACCURATE, RELIABLE, OR AVAILABLE WITHOUT INTERRUPTION. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VODODEX AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Vododex and its operators from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time and may delete your account. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will survive.

13. Changes to the Service and Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located there, to the extent permitted by applicable law.
